By accessing and using Analystra ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Analystra provides real-time visitor analytics for websites. The Service allows you to track visitor activity on your websites in real-time while respecting user privacy.

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental consent
• Not share your account with others
• Notify us immediately of any unauthorized use

4. Credits and Payment

Free Credits: New accounts receive 1,000 free credits upon registration.

Purchasing Credits:

• Credits are sold in packages and charged as one-time payments
• Credits never expire
• Each event (view/heartbeat/leave) consumes 1 credit
• Payments are processed securely through Stripe
• All sales are final except as provided in our refund policy

Refunds: We offer a 30-day money-back guarantee for credit purchases if you're not satisfied with the service.

5. Acceptable Use

You agree NOT to use the Service to:

• Track websites you don't own or have permission to track
• Collect personally identifiable information without consent
• Violate any privacy laws or regulations
• Attempt to circumvent credit limits or payment requirements
• Interfere with or disrupt the Service
• Use the Service for any illegal purpose
• Reverse engineer or attempt to extract source code

6. Data and Privacy

You are responsible for ensuring your use of the Service complies with applicable privacy laws (GDPR, CCPA, etc.). Our tracking is designed to be privacy-first, but you must:

• Include appropriate privacy disclosures on your website
• Obtain necessary consents from visitors where required
• Not attempt to identify individual users from the data

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may:

• Perform scheduled maintenance
• Experience unexpected downtime
• Modify or discontinue features with notice

8. Intellectual Property

The Service, including all software, designs, and content, is owned by Kintiq, LLC and protected by copyright and other intellectual property laws. You may not:

• Copy, modify, or distribute our code without permission
• Remove copyright or proprietary notices
• Use our trademarks without authorization

9. Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Abuse the Service or other users

You may delete your account at any time from your dashboard. Upon termination, unused credits are forfeited.

10. Limitation of Liability

To the maximum extent permitted by law, Kintiq, LLC shall not be liable for:

• Loss of data or profits
• Indirect, incidental, or consequential damages
• Service interruptions or errors
• Third-party actions

Our total liability shall not exceed the amount you paid for credits in the past 12 months.

11. Warranty Disclaimer

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee accuracy, reliability, or fitness for a particular purpose.

12. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or dashboard notice. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration in accordance with Delaware law.
